GIRL KILLED AT CALIFORNIA CONSTRUCTION SITE. FATHER SUES CONTRACTOR AND MANUFACTURER FOR NEGLIGENCE.
Last summer a 12-year old girl died in Shasta, CA when construction equipment fell on her at a building site. Her father is now suing the site contractor as well as the manufacturer of the equipment for negligence. The girl’s skull was crushed when she grabbed on to a metal bar which tipped over on top of her. The bar was part of an L-shaped device which attaches to the front bucket of a loader and is used for lifting. The suit states that the neither the construction site nor the equipment safe or secure. The child and three of her friends passed through the construction site in the evening. As she jumped to grab an accessible metal bar, the entire metal piece toppled onto her head. She died after thee days in a coma. Her father is now suing the construction company and metal equipment maker for her death. The lawyer for the father states that the company should have completely cordoned off the site, and/or secured the construction equipment with chains so that it would not be dangerous. As for the manufacturer, the lawyer cites that the piece of equipment had insufficient safety mechanisms and no warning sign regarding the potential for tipping. The part of the site where the fatality occurred is a fairly well-traveled area that residents often use as a shortcut.

Among the mentally ill, heart disease is the most common killer. Since children are not normally under supervision for fat and lipid changes, researchers highlight the danger of the drugs, and urge parents to have their children who are at risk monitored for lipid changes.

Experts and researchers warn that the new FDA system may not be enough, stating that considering the size and scope of the plan, “its fruits would take years to realize.” Also, the use of Medicare records only allows for a specific demographic to be review: seniors. Additionally, Medicare only collects the needed data if a person files a claim, which is not always the case. Clearly, the new system is a step in the right direction, but much more needs to be done to prevent the release of drugs which prove eventually dangerous and fatal, and whose risks are known too late.

The family of the dead motorcycle driver sued the federal government for $25million; however, they were content with the settlement received. The car driver claimed that he believed had blacked out at the intersection, as a result of being a diabetic and not having eaten all day. In a jury trial in 2003, the car driver was convicted of second-degree manslaughter, with penalties including jail time, probation, loss of driving and law licenses, and a monetary fine. In response, Bayer removed the drug from the market temporarily. An editorial accompanying the study portends the permanent end of Trasylol’s availability to doctors and consumers; although, the Associated Press reports that Bayer and the FDA (U.S. Food & Drug Administration) are awaiting details from the study to see how they will proceed.
