Last summer a 12-year old girl died in Shasta, CA when construction equipment fell on her at a building site. Her father is now suing the site contractor as well as the manufacturer of the equipment for negligence. The girl’s skull was crushed when she grabbed on to a metal bar which tipped over on top of her. The bar was part of an L-shaped device which attaches to the front bucket of a loader and is used for lifting. The suit states that the neither the construction site nor the equipment safe or secure. The child and three of her friends passed through the construction site in the evening. As she jumped to grab an accessible metal bar, the entire metal piece toppled onto her head. She died after thee days in a coma. Her father is now suing the construction company and metal equipment maker for her death. The lawyer for the father states that the company should have completely cordoned off the site, and/or secured the construction equipment with chains so that it would not be dangerous. As for the manufacturer, the lawyer cites that the piece of equipment had insufficient safety mechanisms and no warning sign regarding the potential for tipping. The part of the site where the fatality occurred is a fairly well-traveled area that residents often use as a shortcut.
