MOTORCYCLE CRASH VICTIM’S FAMILY GETS $1 MILLION GOVERNMENT SETTLEMENT FOR WRONGFUL DEATH

Nearly five years after a motorcycle crash at an intersection killed him, the family of the victim has received a $1 million dollar settlement from the government from their wrongful death suit. The victim, a 55 year old man, died when his motorcycle struck the rear of a car running a stop sign. The car was being driven by a government employee on official business, hence the claim against and award from the federal government. In August of 2003, a man driving his Harley Davidson hit the back of a Cadillac driven by a former state attorney general and governor. At the time of the accident, the Cadillac driver was a member of the House of Representatives who was determined to be on official business. The car failed to stop at a stop sign, and as a result the motorcycle driver crashed into the back of the car. The bike rider was killed instantly, and the car driver was injured.

The car driver claimed that he believed had blacked out at the intersection, as a result of being a diabetic and not having eaten all day. In a jury trial in 2003, the car driver was convicted of second-degree manslaughter, with penalties including jail time, probation, loss of driving and law licenses, and a monetary fine. The former politician has since resigned from his public post as Representative.
