SAN DIEGO FREEWAY REAR END ACCIDENT KILLS ONE AND INJURES ANOTHER IN SOUTHERN CALIFORNIA

A car rear ended another vehicle in the car pool lane at the San Diego freeway, commonly known as the 405. When a Toyota Echo stalled the carpool lane, a Mercedes stopped behind it, and then an Altima with the two victims stopped behind it. However, the Mazda that was following the Altima could not stop in time and rear ended the Altima, causing the Altima to crash into the Mercedes and to catch fire. BIKE CRASH INJURES TWO IN LOS ANGELES

A motorist was charged with two felony counts each of reckless driving causing injury and battery with serious bodily injury when he braked hard in front of two cyclists. This incident happened on the popular cyclist route of Mandeville Canyon road in Los Angeles, California. ESCALTOR INJURY IN ELDERY ADULTS DOUBLES, NEW STUDY FINDS

A study conducted by Indiana University found that nearly 40,000 elderly adults had been injured in accidents involving escalators between 1991 and 2005. In addition, the rate of injury in 2005 was found to be double that of the rate in 1991 (11 per 100,000 adults over 65 compared to 4.9 per 100,000 adults over 65). Reviewing data provided by the US Consumer Product Safety Commission, the study also found that 85% of escalator injuries were caused by slip, trip & falls. LOS ANGELES WIDOW FILES WRONGFUL DEATH SUIT AGAINST NAIL GUN MANUFACTURER IN PRODUCT LIABIILTY CLAIM

While working on a vacation home in Rancho Santa Fe, California, a man was fatally injured when a nail gun accidentally went off after he bumped it. The 2 ½” nail fired into his chest and hit a coronary artery. Despite desperate attempts to remove the nail in the operating room, he died in surgery when his heart stopped beating. The widow of the victim filed a wrongful death lawsuit against the nail gun’s manufacturer, Hitachi Koki USA, for negligently designing a defective tool of dangerous character and condition.

Surprisingly, nail gun injuries are not uncommon, particularly given the amount of construction activity that occurs every year. Approximately 42,000 incidents of nail gun injury each year require emergency room visits, with over half over those visits coming from professional workers. The cost of treating these yearly injuries adds up to around $338 million – 10x the cost of treating jigsaw and band saw injuries. It’s not difficult to understand why these power tools account for so much injury. Powered by compressed air, these guns can shoot nails as far as 490 feet per second. Particularly in states experiencing housing booms, consumers tend to what stronger, faster tools. In addition, in an attempt to save time, many consumers often remove the safety settings to allow them to shoot nails more rapidly.

PARENTS FILE WRONGDUL DEATH AND NEGLIGENCE SUIT AGAINST CHILD CARE CENTER IN SON’S DEATH.

A 3-year old boy died at his YMCA daycare center, and his parents are suing the center, six employees, and the ambulance company for wrongful death. The lawsuit claims that all of the parties were negligent, failing to provide proper supervision, training, and care. The child was found unconscious at the childcare center, and he died less than a week later when taken off life support. The toddler was playing in a playhouse with other children at the day care in Massachusetts prior to being found unconscious. CONSTRUCTION WORKER DIES IN FALL FROM 25 STORIES IN SAN DIEGO, CALIFORNIA.

A construction employee died when he fell 25 stories at a condominium building site in downtown San Diego. CAR STRIKES TRAIN NEAR DOWNTOWN LA

There are many different systems to measure the severity of a mild head injury. Some of the systems use loss of consciousness and amnesia as main factors in determining the severity of the concussion. Among these many systems, three are the most popular for classifying concussions: Cantu, Colorado Medical Society and American Academy of Neurology Guidelines for Concussions. brain%20MRI.jpg

Cantu Guidelines for Concusssions
There are three grades in the Cantu guidelines. For a grade one concussion, there is no loss of consciousness and amnesia lasts less than 30 minutes. For a grade two concussion, there is a loss of consciousness for less than 5 minutes and amnesia for a period of less than 24 hours. For a grade three concussion, there is a loss of consciousness for more than 5 minutes and amnesia for more than 24 hours.

Colorado Medical Society Guidelines for Concussions
Similar to the Cantu guidelines, there are three grades. For a grade one concussion, there is some confusion but there is no loss of consciousness. For a grade two concussion, there exists confusion and amnesia but there is no loss of consciousness. For a grade three concussion, any loss of consciousness would qualify.

American Academy of Neurology Guidelines for Concussions
For a grade one concussion, there is some confusion and the symptoms last for less than 15 minutes but there is no loss of consciousness. For a grade two concussion, the symptoms last for more than 15 minutes but there is no loss of consciousness. In order to qualify for a grade three concussion, there has to be a loss of consciousness.

Treatment for Concussions
Usually there are no specific treatments for concussions and most of them go away by themselves. However, one percent of the people who do suffer from concussions may need surgery. Typically, medications are available to treat symptoms such as sleep problems and depression.

Causes of Concussion
While there are many ways to cause a concussion, the most common ways for an adult to have one is by falls and car accidents. Other causes can include assaults, industrial and work related injuries, and injuries that occur at home. The most prominent causes for children from the age group of 5-14 are sports and bicycle accidents. In general, transportation-related accidents are the leading causes of concussions in the United States.

DAUGHTER CAN SUE FOR EMOTIONAL DISTRESS OVER CAR CRASH DEATH OF MOTHER.

In a provocative new ruling, the Supreme Court of New Jersey will allow a woman to sue the other driver for emotional distress. The woman’s saw her mother die during a rear end car accident. Previously, a lower court dismissed the claim for emotional distress. The woman has been diagnosed with depression and PTSD (post-traumatic stress disorder) as a result of the fatal accident.
