In a provocative new ruling, the Supreme Court of New Jersey will allow a woman to sue the other driver for emotional distress. The woman’s saw her mother die during a rear end car accident. Previously, a lower court dismissed the claim for emotional distress. The woman has been diagnosed with depression and PTSD (post-traumatic stress disorder) as a result of the fatal accident. A daughter’s claim for emotional distress incurred from a rearend accident which killed her mother has been reinstated by the State Supreme Court. The decision could have long term effects for others who claim to have suffered emotional and psychological distress from accidents. New Jersey’s current car insurance law normally covers physical injuries sustained in accidents only. The amount of award that the daughter will seek for her emotional injuries has not been disclosed.
