KIA TO PAY $6 MILLION FOR DEFECTIVE BRAKES IN SEPHIA SEDAN. CALIFORNIA PRODUCT LIABILITY ATTORNEYS CAN HELP.
A class action lawsuit filed by multiple owners of Kia Sephia Sedans claimed that their cars had a defective braking system, the replacement or repair of which was not covered by Kia’s warranty. The jury trial ended in a $6 million dollar award for the plaintiffs, all of whom had purchased their cars between 1997 and 2000. The award covers the cost of repairing the faulty brake system for each of the claimants. By not originally covering the cost of the brakes, Kia Motors violated the law, per the 1975 Magnuson-Moss Warranty Act. The class action suit plaintiffs were nearly 8,500 Kia Sephia Sedan owners in New Jersey, each of whom will receive around $750 to repair their car’s brake system. The problem with the brakes was that they improperly overheated, resulting in the need for rotor and pad replacement every 10,000 miles. The claimants stated that Kia performed tests which proved the brake system to be defective, and that coupons sent to cover the potential cost of repair were either insufficient for the amount of repair needed, or in other cases, not honored. Two years ago, a $5.6 million award was ordered to be paid by Kia in a Pennsylvania law suit. Kia was not found guilty of fraud.
