The toddler was playing in a playhouse with other children at the day care in Massachusetts prior to being found unconscious. The suit claims that the boy and other children were unsupervised, and that the children alerted the staff as to something being wrong with the boy. Employees of the YMCA daycare found the child unconscious, and tried different methods to revive him, including splashing water on his neck, removing mulch from his mouth, and CPR. When emergency helped arrived, the boy had no pulse and was not breathing. The ambulance team did not use a defibrillator, but they got him to breathe. In the process, they tore his trachea, causing his lung to collapse. Once at the hospital, doctors attempted to save him. Due to a lack of oxygen, the boy’s brain had swelled; a condition which did not improve even with extensive brain surgery. He died 10 minutes after being taken off life support.
The parents are suing the YMCA, its employees, and the emergency company for negligence. They claim that the daycare center employees neither appropriately supervised their son nor provided appropriate emergency care. The suit also alleges that the ambulance company neither properly trained its staff nor supplied the needed supplies for their child’s treatment. The wrongful death suit calls the child’s death “untimely and tragic,” and states that that it “was preceded by excruciating pain and suffering and severe mental anguish and emotional distress, including knowledge and fear of death.”
