PRODUCT LIABILITY: DEFINITION

Product liability is when people who make products available to the public are held responsible for the injuries that their products caused. A products liability claim is usually based on at least one of these three causes: 1. design defect 2. manufacturing defect; or 3. failure to warn.

Often a product liability claim is based on strict liability. Under strict liability, a manufacturer is held liable for the injuries sustained by the victim regardless of whether he/she acted negligently. Strict liability is serious for the manufacturer because, he/she is forced to pay for all injuries caused by their products even though they are not at fault. However, not all defects can be considered based onstrict liability. Strict liability is only applied to manufacturing defects and is very rarely applied to design and warning defects.
