Text messaging is now illegal while driving in California. Prior to this law, train officials outlawed cell phone usage by railroad engineers completely. Still, it appears that the man driving the Metrolink train that killed more than 20 people in Chatsworth last year was texting while driving. Now lawyers for those killed and injured in the crash say that management received complaints regarding the engineer's text messaging. The crash victims' attorneys states that the company responsible for employing the engineer had information regarding his forbidden cell phone usage and text messaging. Another employee allegedly complained about his phone use days and even hours before the deadly crash. Investigators found that the engineer sent "dozens of messages" while on duty the day of the crash. The employment company's policy forbids cell phone use by employees. It appears that the engineer missed a red light, which led to the fatal crash. The engineer was also killed in the crash, and victims have field a wrongful death and negligence suit against the engineer and the company which employed him.
