NURSING HOME DANGERS PART II: MENTALLY ILL PATIENTS THREATEN SAFETY OF ELDERLY. CALL RESIDENTIAL CARE LAWYERS OF LOS ANGELES.

Nursing homes, also known as residential care facilities, exist to care for those who are unable to care for themselves. In most cases those people are senior citizens. In this second part of our NURSING HOME DANGER blog, we’ll look at the new threat posed by mentally ill patients in nursing homes.

While it may not be the most ideal situation, many elderly Americans spend the end of their lifetime at a nursing home. Seniors enter these assisted living institutions with the expectation that they will be cared for and safe. Unfortunately a new trend brought on in part by the nation’s economic crisis, is compromising nursing home residents’ sense of security. The trend is the growing number of younger mentally ill patients in nursing homes. These patients may pose a threat to their elderly roommates under certain circumstances. Murders, beatings and rapes have been reported at nursing homes around the country. Nine percent of nursing home populations are mentally ill under 65. According to an AP (Associated Press) report, the number is rising and seniors are afraid. If you or a loved one has been hurt or killed at a nursing home in California, call 1-800-ALAWPRO to speak to an attorney for free.

More than 125,000 seriously mentally ill young and mid-aged adults live in residential facilities among often frail seniors. Mental illness including schizophrenia, bipolar disorder and depression can lead a person to require the type of care offered at a nursing home. Without the proper supervision or medication, mentally ill residents may become violent or unstable. Nursing home supervision is often woefully understaffed and unprepared for mentally ill patients, but closing of mental wards and a need to fill nursing home beds has led to the potentially lethal combination of mentally ill and elderly.

While no statistics exist regarding the number of incidents of mentally ill patients hurting elderly patients at nursing homes, there are specific incidence reports. Mentally ill nursing home residents have assaulted elderly residents, leading to their death. Mentally ill resident have started fires that killed more than a dozen patients. Reports of rapes and beatings also exist. Federal law protects all nursing home patients from physical abuse, but the number of non-elderly patients appears to be putting that right at risk. To learn more about elder abuse and victim’s rights, visit our website at www.alawpro.com.

NURSING HOME DANGERS: ASSISTED LIVING NEGLIGENT CARE. CALL PREMISES LIABILITY LAWYERS OF CALIFORNIA NOW (PART I).

Nursing homes, also called residential care or assisted living facilities, are places people go to be cared for in their time of need. In this two-part blog series, NURSING HOME DANGERS, we’ll recount incidents where nursing home residents died; one due to direct negligence on the part of caregivers, and others due to mixed populations, a rising problem among nursing homes. Negligent care at assisted living facilities is the subject of this blog.

Traditionally, nursing homes service elderly populations, but younger people who require 24-hour care also use residential care facilities. Non-elderly assisted living facility clients include those who require care due to paralysis, mental illness, severe brain injury, or other debilitating problems. The safe keeping of all nursing home residents is primarily the responsibility of the facility. Negligent care includes the mistreatment of patients through physical of emotional abuse and/or poorly or unsafely cleaning, medicating or feeding patients. To learn more about nursing home negligence, please visit our website at www.alawpro.com. If you or a loved one has been the victim of negligence at a California nursing home, call 1-800-ALAWPRO to talk to a lawyer for free.

A 36-year old man with a traumatic brain injury was under the care of an Arizona nursing home when he imbibed foreign objects that resulted in his death. His widow has been awarded $11 million after suing the assisted living facility. The victim was 36 at the time of his death, and he had suffered the severe brain injury in a car accident ten years prior. He had been living at the nursing facility named in the suit for exactly one month before his death. He died after eating objects including candy wrappers, paper towels, ketchup packets and plastic bags. The suit found the residential facility guilty of abuse, negligence and wrongful death. Other negligent acts committed by the nursing home in regards to the man included falsifying chart entries.

A woman was found dead, floating at the harbor in Huntington Beach with a “clear wound on her forehead.” It appears that the woman fell, possibly on jagged rocks ornamentally placed outside a nearby bar. The accident is under investigation. In another Huntington Beach incident, a two-year old boy wandered away from his caretaker, slipped through bars and fell to the surf line at the local pier. Miraculously, the boy flipped as he fell 20 feet and landed on his back , suffering only minor bruising.

A settlement has been reached in a case where a Temecula boy fell at a fast-food restaurant playground. The child and his sister were playing at a Burger King restaurant indoor playground, when he fell from a structure onto a tile floor below. He suffered serious brain damage when he hit his head in the fall. The suit named the restaurant franchisee, its parent company as well as the playground installer and manufacturer. There were no warning signs, and no rubber underneath the structure, which included monkey bars and a fireman’s pole. The incident happened in 2005. The boy, who is now 12, and his sister, who suffered emotional distress, were awarded $20 million.

BRAIN INJURY FROM FALL AT SKI SLOPE KILLS NATASHA RICHARDSON. CALL BRAIN INJURY LAWYERS OF LA COUNTY FOR HELP NOW.

The Tony-award winning actress Natasha Richardson died from a head injury she incurred from a fall while skiing. Brain injuries from a traumatic incident such as a fall or a car accident strike nearly 1.5 million Americans annually. About 50,000 of those people will die from their severe brain trauma. The physical force of a fall from a standing position is more than enough to cause such a fatal injury. Sports like skiing, bike riding or skateboarding, as well as slipping or tripping on an uneven surface, can cause such falls or blunt traumas. In some tragic cases, such as those like Ms. Richardson’s, the fall can trigger a bleeding of the brain that is then confined by the skull. The resulting pressure on the brain can be deadly, although prompt medical care can sometimes save the victim. BUS CRASH IN NORTH HOLLYWOOD? ACCIDENT ATTORNEYS ARE HERE TO SERVE YOU.

Bus accidents in Southern California are a dangerous occurrence. Buses are large and have a center of gravity that can be more dangerous than an average sized car. A rollover bus crash can be deadly for passengers inside; sometimes crushing them under a collapsed roof. A head-on or rear end collision with a bus can have serious consequences for those in the vehicle hit by the bus. School bus accidents are also particularly hazardous, since occupants are nearly always children. When a school bus crashes, there may be a number of parties at fault including the driver, the owner of the bus and the school or service that hired the bus for transport. To learn more about bus crashes and victim’s rights, visit our site at www.alawpro.com, or call 1-800-ALAWPRO to speak with a San Fernando Valley area bus accident lawyer for free.

A recent school bus accident in North Hollywood left child passengers unharmed but did hurt a person in the other vehicle. The crash occurred at a bus Valley intersection at Victory and Lankershim. The school bus was carrying a few children when it hit another vehicle. One of the occupants of that auto hospitalized with unknown injuries. The cause of the crash is under investigation. Schoolbus accidents can have a devastating effect on children both physically and mentally. If your child has been involved in a bus crash, please seek legal advice immediately.

LINCOLN HEIGHTS PARKING LOT CRASH. CONTACT LA PARKING GARAGE ACCIDENT LAWYERS NOW.

When people think of Los Angeles car crashes sites, most think of LA’s busy freeways, boulevards and streets. But accidents can happen anywhere cars go, including parking lots. Locations that have a large number of visitors, such as shopping malls, strip malls, airports, restaurants, banks, office buildings, and apartments, usually have parking structures built to accommodate their customers and guests. Parking facilities may be multi-level, below ground, or above ground. They see a lot of traffic each day, and often attempt to fit a large number of vehicles into a small space. Accidents in parking garages are often low speed, but they can still cause serious injury including broken bones and neck injuries. If you have been involved in an LA area parking lot crash, you may not know who to blame: the person you crashed with? the owner of the structure? or both? Call 1-800-ALAWPRO to talk to a LA crash injury lawyer for free.

A crash in a ground level parking lot in Lincoln Heights left a woman and child injured, though not seriously. A fencing structure around the parking lot was also damaged, and the cause of the accident was not known. Parking lots may be the responsibility of the municipality, or land or business owner.
