SIMPLICITY BASSINET CRIBS RECALLED AFTER TWO MORE CHILD DEATHS—CALL LOS ANGELES PERSONAL INJURY LAWYERS NOW
Product liability takes a prominent place in civil law because of the injuries that may happen as a result of certain products. There are certain products that have “strict liability” attached to them. Companies have strict liability for those products that are unreasonably dangerous, even if the company was not responsible for making them defective. Another type of defect is the manufacture product defect, which occurs when a specific product comes out differently than all of the other similar products and causes injury to someone. There are also product design defects, which is when the defect is common to all of the same products but cause injury because of its specific design.
Recently, two more children were killed in Simplicity bassinets, bringing the total to four deaths between 2008 and this year. The bassinets had a design defect in which the Simplicity 3-in-1 and 4-in-1 convertible bassinets had metal bars that were placed farther apart than federal standards allow. If the bassinet bars were not properly covered by the Velcro-attached fabric, then children could become caught in the pocket that the fabric made, or could become stuck between the exposed bars. One of the children died because she was trapped between the exposed metal bars and the other suffocated because she was caught in the fabric.
The Consumer Product Safety Commission has recalled over 900,000 bassinets that have been sold between 2001 and this year.
