On October 12, 2009, a motorcyclist was killed exiting a parking lot in Riverside. The incident happened when the motorcyclist, Orrin Pierre Casey, exited out of a shopping center and was struck by a 94 year old man driving a Ford Focus. AMTRAK TRAIN HITS CAR ON TRACKS IN SANTA FE SPRINGS—HUNDREDS OF TRAIN ACCIDENTS OCCUR EACH YEAR (Part 2 of 2)

An Amtrak train hit a car on the tracks on October 18, 2009. The accident occurred around 9 p.m. when a car was left on the railroad tracks. The occupants of the car, a mother and her daughter, got out of the car right before the train hit. It is still unclear how many people were injured on the train. The Federal Railroad Administration Office of Safety Analysis has published findings regarding trains and the summary of accidents. In 2009 on Amtrak:

  • There were 78 fatalities and 719 nonfatal accidents;
  • There were 17 derailments and 17 accidents were because of track causes;
  • Ten of the accidents were caused by equipment and 10 of those were yard accidents;
  • There were 245 nonfatal employee accidents and 47 fatal trespasser incidents;
  • Six of the accidents were caused by human factors.

On September 25, 2009, Toyota Motor Company recalled 3.8 million vehicles in the United States because of a safety issue involving a rubber floor mat. It is reported that the floor mat on the driver’s side of Toyota’s cars may be ill fitted or unsecured and may cause the accelerator pedal to get stuck. The National Highway Traffic Safety Administration had received approximately 102 reports of incidents that may have been related to the floor mats. Until Toyota or Lexus is able to replace the rubber mat, owners of the cars should remove the mat and not replace it. The recall will affect Toyota Camry, Avalon, Prius, Tacoma, Tundra and several Lexus models.

ONE FATALITY IN RIVERSIDE AND ONE HIT AND RUN DEATH IN MONTEBELLO COULD RESULT IN SERIOUS CONSEQUENCES

There are certain accidents in which fault cannot be assigned to either party because of another intervening force that caused the incident. There are also circumstances in which negligence is present because of specific acts that one of the parties did. HUNDREDS OF BIG RIG TRUCKING ACCIDENTS OCCUR EACH YEAR IN SOUTHERN CALIFORNIA (Part 2 of 2)

The California Statewide Integrated Traffic Records System (SWITRS) produces a summary of accidents, their causes and victims each year. In 2007:

  • There were 320 fatal collisions and 6,942 injury collisions involving trucks, with the most occurring in October and August, respectively;
  • In Los Angeles County, there were 50 fatal truck collisions and 2,101 injury collisions;
  • In collisions where the truck driver was at fault, 32 collisions occurred at unsafe speeds while 17 occurred as a result of improper turning;
  • In collisions where the truck driver was at fault, there were 463 drivers between the age of 40 and 44, and 382 drivers were between the ages of 35 and 39;
  • In 217 fatal collisions involving trucks, the truck was proceeding straight before the accident occurred and 26 were stopped before the collision occurred.

The truck crossed the road and hit the car that Davis was riding in. Hernandez survived, but was cited with driving with a suspended license and other offenses. The settlement occurred relatively quickly in an effort to resolve the issue.

Because the driver had a suspended license but continued driving, it was likely one of the most important elements in the lawsuit. In another unrelated accident on October 1, 2009, Kim Fullenwider of Ojai was arrested and charged with child endangerment after she was caught drinking and driving a busload of students. The accident occurred when Fullenwider tried to make a U-turn but was hit by a pickup truck.

  • The age group with the highest number of fatal collisions was between 20 and 24 years old;
  • In fatal collisions, 486 of them occurred when the collision was head-on and while the cars were moving straight before the collision occurred;
  • There were a total of 813 fatal collisions that occurred head-on, 1,197 accidents in which a vehicle was broadsided, 1,183 accidents where a vehicle hit an object and 476 accidents in which the vehicle overturned;
  • A total of 168,480 people in passenger cars were killed or injured while 11,589 people in on a motorcycle or scooter were injured or killed.
