The victim was attacked by dogs who had escaped their home through a window. The landlords of the property were trying to have the dogs seized by animal control prior to the attack. The people named as defendants in the lawsuit included both the owners of the dogs and the owners of the property from which the dogs escaped. After the attack, the pit bulls were located and killed by police.
The victim’s injuries were so severe that he was on a feeding tube in the hospital for weeks, resulting in bills for over $500,000. The judge ruled that the injuries and lacerations to the man’s face, limbs, and internal organs were permanently “disfiguring and disabling.” In addition to his multi-million dollar compensation, the man’s wife received an award of $300,000.

California imposes a strict liability rule with its “Dog Bite” statute. According to section 3342(a) of California’s Civil Code, a dog owner is responsible for any damages suffered by someone who has been bitten by the owner’s dog. While the rule limits the ability to recover to attacks that occur on public property or where the victim is lawfully in a private area, the statute is written to provide the most protection to the victim of a canine attack. A person is lawfully on private party if invited by the owner or when performing a legal duty (such as a postman or fireman).
