Three separate dog attacks occurred in Southern California this past week, in Chatsworth, Rancho Mirage and Long Beach. In all one person died and four were injured. In the Chatsworth attack, an elderly woman using a walker was attacked by two dogs. The animals knocked her to the ground, leaving her with a back injury and bite marks. A couple of men who attempted to help her were also mauled by the dogs. One of her rescuers suffered a large arm laceration, and the other received serious and potentially debilitating injuries. The Rancho Mirage dog mauling was fatal as a man was killed by Bullmastiffs he was alleged to be attempting to breed. The dogs remained very aggressive after police arrived at the site. Riverside County has now seen two deadly dog attacks in 3 months – the first involved two pit bulls killing a man in his family’s yard. A third attack involved a cocker spaniel and a child in Long Beach. The two-year old girl was attacked by her family dog when it bit her in the face. She was hospitalized with deep cuts or lacerations on her face.

In a related case, the family of a woman who was attacked by a chimpanzee has sued the chimp’s owner for $50 million. As a result of the primate attack, the female victim’s injuries included brain damage, possible blindness, as well as the amputation of her eyelids, lips, nose and hands. The chimpanzee had bitten other people, and at least one official warned the animal’s owner the chimp’s “worrisome behavior.”

An Orange County man and his wife were walking their two large dogs when a pitbull approached them. The pit bull attacked the dogs and then went for the woman. Her husband went into a nearby home and grabbed a knife with which he stabbed the pit bull until it unclamped its jaws from the woman's hand. A man from Rubidoux, CA was killed by a male and a female pit bull as he was standing in his backyard. The dogs, which have since been euthanized, were owned by the victim’s family. Laguna Hills was the location of a bull mastiff attack in which three dogs attacked two people, severely mauling a woman. Those dogs have also been euthanized. In a Camarillo attack, loose two pit bulls attacked another dog. When a couple attempted to stop the attack, they were both bitten by the pitbulls on their hands. One of the victims sustained a bite that was so serious it required hospitalization. Unfortunately, the dog that the people were attempting to rescue was killed by the pit bulls. The attacking dogs in that event have since been impounded.

DOG ATTACK IN PACOIMA: TODDLER BIT IN FACE BY PIT BULL. CALIFORNIA DOG BITE LAWYERS CAN HELP.

A pit bull attacked a 2-year old boy as the child was playing in his backyard, while supervised by his grandmother in Pacoima (located in the San Fernando Valley in Southern California). SAN BERNARDINO DOG BITE ACCIDENT: OWNER LIABLE FOR CHILD’S INJURIES UNDER CALIFORNIA’S “DOG BITE” STRICT LIABILITY LAW

An 8-year old child in San Bernardino suffered severe injuries to the face and thigh when a dog attacked and bit him in January 2008. The boy’s injuries required surgery, and he will be permanently scarred and have loss of skin pigmentation as a result of the attack. The boy was attacked while running away after they allegedly heard the owner order the attack. The dog’s owner, a teenager from Fontana, will stand trial for charges of assault with a deadly weapon.

Dogs bite approximately 4.7 million people annually according to a survey by the National Center for Disease Control and Prevention. Of those injured victims, around 800,000 require medical attention. In addition to cuts, abrasions, and bruises, the strong jaws of a dog can also cause broken bones as well. Severe injuries can cause lasting and permanent scarring, and in some rare cases, death.

dog_bite.jpgCalifornia imposes a strict liability rule with its “Dog Bite” statute. According to section 3342(a) of California’s Civil Code, a dog owner is responsible for any damages suffered by someone who has been bitten by the owner’s dog. While the rule limits the ability to recover to attacks that occur on public property or where the victim is lawfully in a private area, the statute is written to provide the most protection to the victim of a canine attack. A person is lawfully on private party if invited by the owner or when performing a legal duty (such as a postman or fireman).

California’s statute only covers dog attacks that involve the animal actually biting another person. If a person is injured by a dog absent a bite, the “dog bite” statute does not apply. However, this individual may still recover under other common law causes of action such as negligence. Also, when defining “bite,” a California Appellate Court found that broken skin or a visible wound from the dog’s teeth were not required to find liability. In that case, the court found the owner responsible when his dog bit at the victim’s leg and its teeth closed around the victim’s pants leg, causing him to fall off a ladder.

  • Refrain from interacting with unfamiliar dogs, particularly when the owner is not present

  • If you feel threatened by a dog, refrain from making sudden movements or running away. Stay still and back away slowly

  • If a dog knocks you over, curl up, lie still and cover your face

  • Leave dogs alone that are eating, sleeping, or caring for their puppies. Any interaction may make the dog feel threatened and cause it to become defense.

SOUTHERN CALIFORNIA WOMAN MAULED TO DEATH BY DOGS IN BARSTOW, SAN BERNARDINO COUNTY

A tragedy occurred on December 25, 2007 when a San Bernardino County woman was mauled to death by a pack of pit bulls in Barstow. The victim was 45 year old Kelly Caldwell who was found lying in the street Tuesday night by police after they were called to a home in Yermo. She was taken to a nearby hospital but was later pronounced dead according to San Bernardino County sheriff’s department. Authorities say that three pit bulls surrounded and then attacked the woman, and then ran to a nearby house. One of the dogs returned to the scene while paramedics were trying to save the victim’s life, and deputies were forced to shoot the dog as it started acting aggressively. Another dog was shot to death the next morning as an animal control office was attempting to capture it. Deputies said that the second animal also became very aggressive. Authorities have said that at least one of the dog belonged to a neighbor, but no arrests have been made.

DOGS BITE 77 POSTAL CARRIERS IN LOS ANGELES IN 2006: ORANGE COUNTY-LONG BEACH AREA RECORDS 96 DOG BITES

Southern California had its share of dog attacks in 2006, some resulting in serious injuries. These dog bite attacks are prompting cities, such as Torrance and Redondo Beach, to rethink their dog laws. These two cities are reacting to recent incidents where residents were injured. In Torrance, a vicious pit bull attack left a 60-year-old mail carrier in the intensive care unit of a local hospital with severe facial wounds. In Gardenia, there was a serious incident which involved two loose pit bulls. This past July, a Pasadena man was arrested after his roaming pit bull attacked three people.

These nationwide headlines are prompting city governments to enact legislation to restrict certain breeds of dogs. A Centers for Disease Control and Prevention study found that fatal attacks on people appear to be related to specific breeds, with pit-bull type dogs and Rottweilers being the top offenders. But other breeds of dogs also pose dangers, and it’s not clear that breed-specific laws would be practical or constitutional.

According to the U.S. Postal Service, dogs bit 3,184 mail carriers last year. In Southern California, the problem of dog attacks is serious. The Los Angeles-Orange County area saw 226 carriers bitten in 2006. In Orange County-Long Beach alone, 96 dog bites occurred last year, which was the most of any region. The city of Los Angeles alone had 77 recorded incidents of dog bites.
