A patient at the Fillmore Convalescent Center in Ventura County was abused by an employee, and her family sued the nursing home, ultimately collecting $7.75 million. Huntington Valley Healthcare Center in Huntington Beach has been fined $80,000 by the California Department of Public Health after a patient died. Apparently the nursing staff believed, mistakenly, that the elderly resident had a DNR (Due Not Resuscitate) order. When the patient had a heart attack, they did not attempt to revive him or call paramedics.

Alamitos West Health Care Center in Los Alamito, OC, has been fined $100,000 by the CA Dept. of Public Health. State officials found the nursing home negligent for failing to provide an 82-year old female resident with proper fluid intake, resulting in her death. They also discovered that the facility did not heed doctor’s orders regarding the patient and kept shoddy records of her progress and care. The woman died after being hospitalized with dehydration, a bladder infection, and altered mental status.

Two instances of financial elder abuse made news in the Southland this the past month. In Santa Ana, an insurance agent was apprehended by police. He allegedly tricked an 82-year-old Rancho Cucamonga woman into giving him $114,000 from her savings and buying an unneeded $13,000 insurance policy. A recent lawsuit has an elderly nursing home resident suing her facility after she was sexually assaulted by a 21-year-old with bipolar disorder. The 69-year-old victim’s lawsuit alleges that not only did her Illinois home allow a dangerous mentally ill young adult live amongst frail seniors, but that they also attempted to cover up the rape. The man who attacked her had previously been a resident at the nursing home and was a convicted felon. He had admitted to staff that feeling sexually frustrated, yet nothing was done to keep him from harming residents.

NURSING HOME FIRES KILL AND INJURE SENIOR RESIDENTS IN SOUTHERN CALIFORNIA. CONTACT LA ELDER ABUSE LAWYERS NOW.

Now the assisted living facility has been fined $100,000 by the State of California, the highest fine possible. The senior victim died after sustaining burns on more than 40% of his body. He accidentally set himself on fire lighting a cigarette. An investigation discovered that the nursing home permitted smoking but lacked a safety plan. Also staff did not react by using a fire extinguisher or fire blanket, both of which were available.

In Temecula, a nursing home caught fire, injuring 4 people and displacing 34 residents. The fire took place in the attic of the senior residence facility. The people who were hurt suffered smoke inhalation. The cause of the fire was unknown and under investigation.

A 36-year old man with a traumatic brain injury was under the care of an Arizona nursing home when he imbibed foreign objects that resulted in his death. His widow has been awarded $11 million after suing the assisted living facility. The victim was 36 at the time of his death, and he had suffered the severe brain injury in a car accident ten years prior. He had been living at the nursing facility named in the suit for exactly one month before his death. He died after eating objects including candy wrappers, paper towels, ketchup packets and plastic bags. The suit found the residential facility guilty of abuse, negligence and wrongful death. Other negligent acts committed by the nursing home in regards to the man included falsifying chart entries.

The Anaheim nursing home at which the choking death occurred had a history of warnings including poorly secured doors. In this most recent event, an elderly man suffering from dementia died after choking on a tuna sandwich. His death was erroneously reported as a heart attack, but an investigation illuminated a different cause. Due to his condition, the man was to be served pureed food only. During the day of his death he was once fed non-pureed food on which he choked but recovered. Later in the day he was left near a food cart, which contained sandwiches. He took one, choked and died. Allegedly, staff at the residential home did not check his airway or provide emergency resuscitation during the incident. The state fined the nursing home $75,000.

ESCONDIDO NURSING HOME SUED FOR WRONGFUL DEATH BY FAMILY OF ELDERLY RESIDENT. VICTIM HIT BY CAR.

A 94-year old resident of a nursing home in Escondido, CA was killed when she wandered out into the street and was hit by a car. Her son has filed a wrongful death suit against the nursing home. The woman, who was suffering from senile dementia, was a resident of the facility for more than 2 years. She died when she was hit by a car in a traffic lane a few hundred yards from the home. The lawsuit seeks over $25,000 in damages and alleges that the nursing home did not “supervise and ensure the safety” of the victim. On Thanksgiving morning last year the senior victim left her nursing home and wandered into the street where she was killed. The elderly woman’s son stated that this was not the first time his mother had been allowed to leave the facility unattended. Earlier this year the nursing home was fined $100,000 by the Department of Public Health for the woman’s death. ELDERLY MEN KILLED IN NURSING HOME FIRE. FAMILY SUES FOR WRONGFUL DEATH

Two seniors residents died and two others were injured in a fire at a nursing home last week. The family of one of the victims has sued the home for wrongful death, citing poor safety preparation and equipment. Elder abuse is the mistreatment of an older adult by a person or entity with which there is an expectation of trust. Abuse can be physical, financial, emotional or otherwise, and includes neglect and abandonment. Abuse need not be intentional, but it must cause the elderly victim harm or distress. The men who were killed in the fire were roommates, and the fire began in their closet around 11pm. Officials stated that “smoldering smoking materials” may have been the fire’s cause; however, the investigation is ongoing. The residents of the nursing home were alerted as to the fire by “individuals banging on their doors and coming in their rooms.” Neither smoke alarms nor fire alarms awakened the residents. It is unclear if any attempt was made by staff members to enter the room where the fire originated.

The suit seeks an inquiry as to whether safety equipment at the nursing home, including smoke and fire alarms, was installed and working properly.
