MOTORCYCLE ACCIDENT IN LOS ANGELES; DRIVER KILLED AFTER HITTING BIG RIG

A motorcyclist was killed after colliding with a big rig on a freeway connector, and authorities closed down the connector between two freeways due to this accident. MOTORCYCLE ACCIDENT LEADS TO DEATH IN LOS ANGELES

A motorcyclist crashed into the rear of a stopped freight truck and was unfortunately declared dead several minutes later. The stopped truck had its hazard lights on but the motorcyclist collided with the rear left end of the truck. Police are investigating what the cause of the accident was. BIKE CRASH INJURES TWO IN LOS ANGELES

A motorist was charged with two felony counts each of reckless driving causing injury and battery with serious bodily injury when he braked hard in front of two cyclists. This incident happened on the popular cyclist route of Mandeville Canyon road in Los Angeles, California. MOTORCYCLE CRASH VICTIM’S FAMILY GETS $1 MILLION GOVERNMENT SETTLEMENT FOR WRONGFUL DEATH

Nearly five years after a motorcycle crash at an intersection killed him, the family of the victim has received a $1 million dollar settlement from the government from their wrongful death suit. The victim, a 55 year old man, died when his motorcycle struck the rear of a car running a stop sign. The car was being driven by a government employee on official business, hence the claim against and award from the federal government. In August of 2003, a man driving his Harley Davidson hit the back of a Cadillac driven by a former state attorney general and governor.     MOTORCYCLE DEATH RATES ON THE RISE WITH MIDDLE-AGED MEN DUE TO TRENDINESS AND WEAKER HELMET LAWS

    A frightening new analysis by Gannet New Service shows that motorcycle fatalities are on the rise at a staggering rate, and the victims are getting older. The results point to the weakening of helmet laws across the country and a new trend in motorcycles for middle-aged men. Bike crashes account for a disproportionately high number of traffic accident deaths. While California maintains helmet laws, hundreds of motorcyclists continue to be killed in crashes.     The LA Superior Court found in favor of a motorcyclist who was severely injured when he was struck by a car years ago. As the result of massive injuries sustained, the jury awarded the injury victim $3.6 million in medical bills and lost wages and another $15 million for pain & suffering. When the accident occurred, the driver at fault, the wife of a company executive who had recently moved to the United States from Taiwan, did not have her California’s drivers license. In fact, just four days before, she had tried to pass the California driving test and failed. However, because California law allows drivers to use foreign licenses if they aren’t officially residents yet, she was legally allowed to drive with her foreign license.

    ORANGE COUNTY, CA FATAL ACCIDENT ON COSTA MESA FREEWAY CAUSES MOTORCYCLE AND CAR PASSENGER DEATHS

    A six-vehicle crash in the City of Orange left one motorcyclist and one driver of a car dead this past weekend. The crash occurred on the Costa Mesa freeway (also known as California Highway 55). According to authorities, the motorcyclist suddenly lost control, struck the center highway barrier, and flew off of his motorcycle into oncoming traffic. The other fatality occurred when the driver of another automobile swerved to avoid the motorcycle victim, lost control of his own car, hit the highway’s guardrails, and was struck by a third car. Six vehicles were involved in the fatal accident.

    MOTORCYCLE CRASHES IN CALIFORNIA: KNOW THE LAWS

    The number of motorcycle crashes in California has continued to steadily increase as reported by the National Highway Traffic Safety Administration (NHTSA). In addition to an increasing number of vehicles on the road, driving conditions and negligent drivers are contributing to the problem. For this reason, it is critical that motorcycle riders know and understand the laws of their state. Below is a quick summary of California’s motorcycle laws.

    • Helmet: required by law

    • Eye protection: not required

    • Helmet speakers: single earphone only

    • Daytime use of headlights: required by law

    • Turn signals: required by law

    • Safety inspections: required by law at random

    • Lane sharing: In California, motorcycles may drive between cars but must take reasonable care when doing so. Motorcycles may not drive on shoulders. Also, two motorcycles may share a lane.

    • Maximum speed: 70 mph in rural areas; 65 mph in urban areas

    • Blood alcohol limit (over 21): .08

    • State insurance requirement: Compulsory Liability (Minimum Limits) (15/30/5) - Financial responsibility is required.     BALDWIN PARK, CALIFORNIA MOTORCYCLE RIDER FAILS TO WEAR HELMET AND DIES IN ACCIDENT

    A man took his friend’s motorcycle for a test run in Baldwin Park, CA last fall and collided while attempting to pass a tractor-trailer truck that was concurrently making a left turn into a parking lot. As the truck turned, the rider lost control of the bike and became entangled underneath the trailer’s tires. At the time of the crash, the man was not wearing a helmet. He died instantly.

    Although wearing a helmet while riding a motorcycle is required by law in the state of California, many drivers often fail to do so – either out of laziness or pure recklessness. As evidenced by the story of the Southern California Baldwin Park man, the consequences can be fatal. Studies published by the National Highway Traffic Safety Administration (NHTSA) show a significant correlation between helmet use and head injuries among those fatally injured in motorcycle collisions. 51% of un-helmeted motorcyclists suffered a head injury, compared to only 35% of those that actually wore a helmet. Furthermore, a study conducted by the Harborview Injury Prevention Center found an 88% reduction in brain injury for riders who used a helmet. Because motorcycles lack the physical protection that enclosed automobiles and trucks possess, riders should take every precaution possible to protect themselves from bodily injury.

    Data shows that the road is becoming an increasingly dangerous place for motorcyclists. While the number of registered vehicles continues to increase, the number of registered motorbikes on the road continues to climb as well.     NORTHRIDGE MOTORCYCLE CRASH ACCIDENT VICTIM OBTAINS LARGEST COURT AWARD; CITY OF LOS ANGELES FORCED TO PAY $15.7 MILLION IN MEDICAL, PAIN & SUFFERING, AND EMOTIONAL DISTRESS

    A retired police officer sued the City of LA when he was hit by a city-operated dump truck while riding his motorcycle in Northridge, California. As a result of the very serious motorcycle accident, the man suffered severe brain injury which caused him to suffer from short-term memory loss. After a two-year lawsuit, the man was finally able to receive ample compensation for damages suffered from this traumatic accident.

    The case went finally went to trial after prolonged settlement negotiations failed to materialize. Even though the retired officer suffered severe brain injury and now requires 24-hour care as a result of the collision, the city never offered more than $50,000. The key issue in the case was the degree of the city’s liability. City attorneys contend that the driver of the dump truck was merely a contractor of the Bureau of Street Services, and thus an independent worker outside of the responsibility of the city. In addition, they argued that the driver had finished his day’s shift and was thus “off-site” when the collision occurred.

    Luckily, the jury was more sympathetic to the victim of this tragic motorcycle accident. Despite the city’s attempt to escape liability, the jury found that the city was indeed liable for the man’s injuries. The Chatsworth Superior Court awarded him $4.7 million for his past and future medical expenses and lost wages. In addition, the court also awarded the man an additional $11 million to compensate for his pain and suffering and emotional distress. This was the largest award given out by this court.

    Both paraplegia and quadriplegia are conditions which result from injury or trauma to the spinal cord. Paraplegia is a condition where someone is paralyzed and cannot move their legs.     Spinal cord injuries are described by where on the spinal cord they have happened. Caregivers use letters and numbers to describe where your spinal cord is injured. There are eight cervical, twelve thoracic, five lumbar, and four sacral bones. So for example, if you have a “T5” spinal cord injury, that means that the damage to the spinal cord occurred at the fifth bone in the thoracic spinal cord section. Generally the level of function lost corresponds to the level in the spinal cord where damage took place. That means that people who suffer an injury to the upper part of the spinal cord have greater injuries and are most likely quadriplegics (or tetraplegics). People who incur injuries to the lower spinal cord are often paraplegic. Spinal cord injuries are also described as complete or incomplete. This refers to how much function (defined as movement and feeling) is left after a person has healed from the injury. A complete SCI means that a person has totally lost the movement and feeling below the injured level. An incomplete SCI does not cause total loss of movement or feeling.

    BROKEN BONES COMMON INJURIES IN CAR ACCIDENTS: A LAWYER CAN HELP GET YOU COMPENSATION

    TYPES OF FRACTURES
    There are many types of fractures, but the main categories are simple and compound (whether or not the bone breaks through the skin) and complete and incomplete (the way the bone breaks). In a simple fracture, also called a closed fracture, the bone breaks but there is no open wound in the skin. A compound fracture, also referred to as an open fracture, is when the bone breaks through the skin; it may then recede back into the wound and not be visible through the skin. Complete and incomplete fractures refer to the manner in which the bone breaks. In a complete fracture, the bone breaks into two or more parts. In the case of an incomplete fracture, the bone cracks but does not break all the way through. Simple fractures include:

    Buckle Fracture: Part of the bone buckles and ruptures, but doe snot break into pieces.

    Greenstick fracture: an incomplete fracture with small cracks in the bone.

    Avulsion Fracture: An avulsion fracture is when a tendon that attaches a muscle to a bone pulls a piece of the bone apart.

    Transverse fracture: a fracture at a right angle to the bone's axis.

    Hairline Fractures: Small fault lines in the bone, but the bones remain connected.

    Oblique fracture: a fracture in which the break slopes.

    Comminuted fracture: a fracture in which the bone breaks into several pieces. These breaks may require metal plates to repair.

    An impacted fracture is one whose ends are driven into each other (also known as a buckle fracture). Other types of fracture are pathologic fracture, caused by a disease that weakens the bones, and stress fracture, a hairline crack.

    KNEE INJURY ACCIDENT LAWYER CALIFORNIA: PATELLA FRACTURE (PART II)

    In yesterday’s blog we talked about knee injury accidents and how serious they can be. Yesterday’s blog focused on Medial Meniscus Tears. Today we will be talking about Patella Fracture injuries.

    PATELLA FRACTURE: A Patella fracture is also known as a broken knee cap. The kneecap bone is one of three bones that make up the knee joint. A patella can fracture in a single crack across the kneecap, or the fracture can result in the kneecap breaking in several places, which is known as a stellate fracture. Patella fractures are usually caused by a strong direct blow to the knee, such as a knee smashing into the dashboard of a car in an accident or a fall onto the kneecap. When this happens, there is usually also external damage to the skin with abrasions and lacerations. A patella fracture usually requires a trip to the hospital to x-ray the knee to assess the extent of the damage. If the fracture is just a small crack and a patient can perform a straight leg raise, generally surgery can be avoided. In these cases, a leg cast or knee immobilizer can be used to treat the minor fracture. However if the fracture is more serious and the knee cap is broken into several pieces or severely disrupted, it is usually necessary to operate on the knee cap to realign the bone. In this case, an incision is made over the frong of the knee joint. The fractured ends are realigned and held in place with a combination of pins, screws and wires. When damage to the kneecap is so several that realignment is impossible, it may be necessary to remove the kneecap entirely. In this instance the leg is usually put in a cast for six weeks.

    MEDIAL MENISCUS INJURY: There are two menisci in a knee that are made of touch cartilage. The medial meniscus is a cartilage that curves in a knee joint on the inside of the knee. The other meniscus is called the lateral meniscus and rests outside the knee. These meniscus distribute a person’s body weight across the knee joint. Meniscus injuries usually involve a tear in the cartilage. The most common was a traumatic meniscus tear occurs is when the knee joint is bent and the knee is then twisted. A radial tear occurs when the meniscus tears from the inside to the outside rim, but tears can also occur lengthwise. A bucket-handle tear occurs when a lengthwise tear rotates into the knee joint instead of remaining around the joint’s edge. It is common for a meniscus tear to along with injuries to the anterior cruciate ligament (ACL) and the medial collateral ligament (MCL). When these three problems occur together they are knows as the unhappy triad. Some meniscus tears result in a locking of the knee joint and these injuries usually require an operation to correct the condition.

    CALIFORNIA MOTORCYCLE ACCIDENT: DRIVER SUFFERS BULGING DISC INJURY IN HOLLYWOOD

    Our client was riding his motorcycle when he collided with a car in an intersection in Hollywood, California. As a result of the motorcycle accident, our client suffered a bulging disc injury (also known as a herniated disk). Our client lived in the canyons of Los Angeles, and he was an experienced motorcycle rider. The canyons in the Hollywood Hills are very narrow, and they have many small side streets that enter into the canyon roads. As our client was driving down the canyon, the defendant stopped at a stop sign on a side street leading into the canyon. The defendant negligently started moving forward as the motorcycle approached where the defendant was entering the canyon road. The motorcycle and automobile collided sending the motorcycle rider flying off the motorcycle and into the bushes. At first our client thought he only had bumps and bruises, and he saw a chiropractor. After a few months, he was still hurting, and the chiropractor referred him to an orthopedic doctor who took an MRI scan of our client's back. The MRI showed a small bulging disc at L-4 L-5 in the low back.

    Our client was a film editor who would have to sit for many hours at a video machine viewing and splicing film. Although it would hurt him to sit for a long time, he elected not to have an operation. We argued at trial that the jury would either have to compensate our client for a life time of pain if he didn't have other operation, or they would have to give him enough money to pay for the operation in the future.

    This case went to non binding arbitration with another attorney, and they were awarded $18,000. The defendant's insurance company did not accept the non binding award and opted for trial which is when we took over the case. Although the defendant's liability insurance policy was for $100,000, the insurance company paid the entire judgment of $325,000 without appealing.

    SPINAL CORD INJURY: LEADING CAUSES ARE CAR ACCIDENTS AND FALLS

    Nearly 11,000 people sustain a spinal cord injury every year. Some spinal cord injuries are fatal and some result in paralysis or quadriplegia. Car accidents are responsible for nearly half of all spinal cord injuries, and falls the second most common reason for spinal cord injury. Over 250,000 people living in the US are suffering from a spinal chord injury and more than 190,000 people in the US live with paralysis due to a spinal cord injury.     Spinal cord injuries usually occur when a blow fractures or dislocates the vertebrae. Most injuries don't sever the spinal cord. Damage actually occurs when pieces of vertebrae rip into cord tissue or press down on the nerve parts that carry signals. In a complete spinal cord injury, the cord can't relay messages below the level of the injury. People become paralyzed below the level of injury. In an incomplete injury, you have some movement and sensation below the injury.     MOTORCYCLE ACCIDENT IN LONG BEACH CAUSES SEVERE ROAD BURN: CLIENT’S LEG AMPUTATED DUE TO ACCIDENT INJURIES

    This motorcycle accident happened in Long Beach, California in Los Angeles County. A car crashed into his motorcycle after it entered the intersection at the wrong time. Our client’s leg was dragged across the ground causing a severe road burn (also known as road rash). Road burn occurs when bikers are thrown or dragged by their bikes, and their skin comes in contact with pavement, gravel, or ground surfaces. Road rash injuries take time to heal and often leave behind permanent scars and disfigurement. In the case of our client, all of the flesh and skin was removed from his ankle. He ultimately needed to have his leg amputated from the ankle down as a result of his road burn. Although the motorcycle crash was a minor impact between the motorcycle and the car, he suffered serious injuries from being dragged across the road and his roadburn was severe.

    Our client was an experienced motorcycle rider. He went for a ride and had his sister on the back of his motorcycle. He slowly entered the intersection, not going more that 20 mph. A car negligently entered the intersection at the same time hitting the bike and causing our client to skid across the street for approximately twenty feet. His sister was luckily not injured. Our client, the rider, unfortunately did not have boots on- he was just wearing tennis shoes. The foot that was under the motorcycle slid across the rode, under the motorcycle for about twenty feet dragging off all of his skin and flesh from around the ankle. The injury resulted in the amputation of his leg. The rider called the Law Offices of Greenberg & Rudman LLP and hired us as his motorcycle accident lawyer.

    As our client was still hospitalized, he asked if I could come to the hospital to have him sign the retainer and give me the information on the accident. At the time, I was a young personal injury lawyer, and hadn't seen many seriously injured people. My client was lying in bed covered with a sheet when I entered the hospital room. I didn't know the extent of his injury, but I thought with a low impact motorcycle crash and no spinal injury, no brain injury and no head injury, how badly could he be injured?     TRACTOR TRAILER TRUCKING ACCIDENT KILLS WIFE AND CHILD ON SAN BERNARDINO RIVERSIDE FREEWAY; WRONGFUL DEATH CASE WON BY SURVIVING FAMILY

    A tractor trailer big rig truck caused a fatal auto accident on a San Bernardino Riverside freeway when it struck a car carrying a mother and child. Their car erupted in flames, and both were burned to death in this tragedy. We sued both the tractor and trailer for negligence and wrongful death as a result the accident, and we settled the case for the policy limits of $1,500,000. While no amount of money is just compensation for the wrongful death of a loved one in a car accident, personal injury lawyers can help surviving family members receive some compensation for their loss that can hopefully help them put the pieces of their lives back together. Our clients were the surviving husband and his two remaining children who live in Fontana, California.

    The husband and surviving children would have a wrongful death claim against anyone who was found to be negligent who contributed to the deaths of their mother and sibling. We knew that this would be a difficult wrongful death case because their car was totally destroyed in the fire, which made it impossible to reconstruct the auto accident to determine what caused their car to go out of control in the first place. Our client’s wife got on the 210 freeway in San Bernardino with one of her children to drive five miles to a store just a few off ramps away. For some unknown reason, her car went out of control, crossed the freeway from the number four lane to the center, struck the center divider, came all the way back across the freeway and was struck broadside on the passenger side by a tractor trailer in the number four lane. The car then erupted in flames from the impact, and they were killed in the fire. The husband was a California Highway Patrol officer who was called to the fiery scene and arrived there with his other children. Fortunately they were kept away from the wreckage which was still on fire.

    Many times we have cases where the original negligence or accident did not cause the ultimate death or damages. In this case, clearly, if the tractor trailer had not impacted the car at a high rate of speed, the car would have continued across the freeway, not caught on fire, and ended up on the side of the freeway. We sued the tractor trailer for negligence in not seeing the car initially lose control as it started sliding from the number four lane to the center divider and to slow up or to pull over when the car started to slide back across the freeway. Our accident reconstruction expert determined that the tractor trailer had seven seconds to see the car and to react, which was enough time to have taken evasive action. The expert for the tractor trailer indicated they would have had four seconds from the time the car hit the center divider, which would still have been enough time to substantially slow or turn to the shoulder. In these type of cases, we always hire a number of experts who help reconstruct the accident. Many times we spend over $100,000 for experts to help explain what happened, why and how it could have been avoided.

    The tractor only had a policy of $750,000. Many accident attorneys don't realize in tractor trailer cases that the trailer also may have their own policy that covers the claim, and in some cases even the owner of the load can be liable. Although $1,500,000 is not enough to compensate the family for the negligence of the tractor trailer and the wrongful death of the wife, mother and child, the defendant driver/owner did not have any other assets. The two surviving children will have their portion of the settlement put in a structured settlement to pay for their college when they get older, and it will accumulate sufficient funds for them to buy a house or start their own business when they get older.

    MOTORCYCLE ACCIDENT, WRONGFUL DEATH IN LOS ANGELES COUNTY INTERSECTION: 17 YEAR OLD SUV DRIVER'S NEGLIGENCE IN MAKING A BAD LEFT TURN CAUSES DEATH OF MOTORCYCLE RIDER- PERSONAL INJURY LAWYER OBTAINS $2 MILLION VERDICT

    In a wrongful death motorcycle accident negligence case last year, we obtained a $2 million verdict for our client whose 29 year old son was killed while operating a motorcycle because a 17 year old SUV driver made a bad left turn in front of him at an intersection, in Pasadena, Los Angeles County, California.

    On the night of the accident, our client's son, a motorcycle operator, was traveling through a traffic controlled intersection, when an SUV driver coming from the opposite direction negligently made a bad left turn on a yellow light, causing the accident and our client's son's death.

    The SUV driver was insured by Allstate Insurance Company, and had a $100,000 insurance policy. However, Allstate refused to pay the $100,000 to settle the case because it felt the police report was in the SUV driver's favor.

    The police report, based on a few statements of claimed eye witnesses, said that our client’s son caused the accident by entering the intersection on a red light, and that the defendant SUV driver legally made his turn from the middle of the intersection, having waited for the light to turn red.

    turner-v-wu-overhead.jpg We hired an expert who analyzed the scene of the accident, the photographs taken by the police, and the vehicles involved in the accident. He testified at trial that the physical evidence such as the skid marks, the debris left by the vehicles in the roadway at the time of the accident, the damage pattern on the vehicles themselves, and the position of rest of the motorcycle, proved that the Defendant SUV driver was speeding, started his turn before he reached the intersection by cutting across the double yellow lines, and made his turn when he should have seen that the motorcycle was too close. Our expert also testified that the light was yellow both at the time that the motorcycle entered the intersection and at the time of the accident.

    The defense hired multiple experts which testified that the SUV driver began his left turn in the middle of the intersection, as the light turned from yellow to red, and that he did not see the motorcycle approaching before the accident. The defense experts testified that the motorcycle entered the intersection on a red light, speeding 5-10 mph over the posted speed limit and accelerating into the intersection. Lastly, the defense experts testified that the SUV driver couldn’t see the motorcycle because it was night time, and the motorcycle’s lights were masked by the lights of the cars traveling behind it.

    Defendants called the witnesses listed in the police report to testify at trial. But we were able to show that the witnesses either did not have a good vantage point to see the whole accident, or that what they saw actually supported our theory of the case.

    The jury found the 17 year old driver of the SUV to be negligent and the sole cause of the motorcycle driver’s death. The jury awarded $2 million to his mother in wrongful death damages (i.e. compensation for the loss of her son’s love, companionship, comfort, care, assistance, protection, affection, society, and moral support).

    The defense appealed the verdict all the way up to the California Supreme Court, but we successfully fought the appeals, and the decision was allowed to stand. Also, our client was awarded interest for the amount of time delayed by the appeals.

    Because Allstate had unreasonably refused to settle this very serious wrongful death case for the $100,000 policy limits before trial, and because it faced a potential insurance bad faith lawsuit from the SUV driver for failing to protect him by paying his policy limits and thereby exposing him to the $2 million verdict, Allstate was forced to pay the full judgment.
